Administrative Court Procedures for Foreigners in Turkey

It is natural for foreigners living in Turkey or having business in Turkey to occasionally enter into dispute with administrative authorities. Many matters such as visa denial, residence permit cancellation, deportation order, restriction code, tax penalty, municipal penalty, tender decision, or construction permit denial can become subjects of lawsuit before Turkish administrative courts. This guide covers foreigners' processes for applying to administrative courts, competent courts, and lawsuit procedure.
Structure of Administrative Judiciary
In Turkey, the administrative judiciary has a three-tiered structure:
1. Courts of First Instance
- Administrative Court: General administrative disputes (visa denial, residence permit cancellation, permit and license transactions, etc.),
- Tax Court: Disputes regarding tax, fee, and financial obligations.
2. Appeal
- Regional Administrative Court: Authority for objection against first instance decisions.
3. Cassation / Final Decision
- Council of State: Highest administrative judicial authority.
For a foreign applicant, this three-tiered structure requires careful management of the lawsuit.
What Matters Are Heard at Administrative Court?
Typical situations that can be the subject of a lawsuit at an administrative court:
1. Transactions Related to Foreigners Legislation
- Visa denial,
- Residence permit denial or cancellation,
- Deportation order,
- Restriction code applications,
- Work permit denial or cancellation.
2. Permit, License, and Authorisation
- Municipal building permits,
- Workplace opening and operating permits,
- Sectoral licenses.
3. Tender and Public Contracts
- Tender decisions,
- Public contract processes.
4. Administrative Sanctions
- Traffic penalties (administrative fines),
- Environmental penalties,
- KVKK penalties,
- Municipal sanctions.
5. Civil Service and Discipline
- Civil servants' disciplinary and assignment transactions.
6. Compensation Lawsuits
- Compensation for damage suffered due to administration's wrong act or negligence.
Competent Court
For a foreigner, determining the competent court to file a lawsuit is important:
- General rule: the court of the place where the headquarters of the administration making the transaction is located,
- For foreigners legislation transactions, the court of the province where the migration administration making the transaction is located,
- For central administration transactions, Ankara Administrative Court,
- For transactions made in Antalya, Antalya Administrative Court.
A lawsuit filed at the wrong court is not rejected but referred to the competent court; this leads to time loss.
Lawsuit Filing Period
In administrative judicial cases, the statute of limitations is very critical:
- General rule for administrative court lawsuits: the period prescribed by administrative procedure rules,
- Shorter period for tax court lawsuits,
- The period runs from the notification date of the administrative act.
When the period is missed, the lawsuit is dismissed on substantive grounds; therefore, getting legal support immediately after notification is essential.
Foreigner Filing Lawsuit Without Being in Turkey
A foreign applicant can file a lawsuit at an administrative court without coming to Turkey:
- Authorises a Turkish lawyer with an apostilled notarised power of attorney,
- A sworn Turkish translation of the power of attorney is obtained,
- A power of attorney signed at a Turkish consulate is also valid.
This way, a foreigner can run all trial processes through their counsel.
Stay of Execution
Stay of execution is one of the strongest measures in administrative judiciary. When filing a lawsuit, a stay of execution is requested; the court evaluates:
- The possibility of winning the case on the merits,
- Irreparable or hardly reparable damage that may arise if the act is enforced
and decides. When a stay of execution decision is given, the consequences of the administrative act are suspended until the case concludes.
Petition Preparation
An administrative court petition should include the following elements:
1. Parties' Information
Identity and address information of plaintiff and defendant.
2. Identification of Subject Act
Which administrative act's cancellation is requested, and when it was notified.
3. Legal Reasoning
Reasons of unlawfulness of the act:
- In terms of authority,
- In terms of form,
- In terms of cause,
- In terms of subject,
- In terms of purpose.
4. Request
In a cancellation lawsuit: cancellation of the act and a stay of execution request. In a compensation lawsuit: the compensation amount and basis.
5. Documents
All documents attached to lawsuit petition.
Trial Process
The administrative trial process:
- Filing petition: The petition and attachments are submitted to the court.
- Court's notification: The petition is notified to the defendant administration, and a response is requested.
- Response petition: The administration's response is received.
- Reply to response, second response: The parties' additional statements.
- Expert review: An expert report is obtained on technical matters when necessary.
- Hearing: A hearing is not held in every file in administrative judiciary; it can be optional.
- Decision: The court's reasoned decision.
In administrative judiciary, written trial is the rule; the oral trial rate is relatively low.
Expert and Documents
Expert reports and documents are the foundation of administrative trial:
- The court can request a report from a court-appointed expert,
- An expert can also be appointed at a party's request,
- The original or a certified copy of documents is submitted,
- Apostille and translation are mandatory for foreign documents.
Decision and Consequences
Decisions the court can give:
Cancellation Decision
The administrative act is cancelled. In this case:
- The act is deemed never to have been done,
- The resulting consequences are reversed,
- If the administration needs to issue a new act, it does so.
Rejection Decision
The court decides the administration's act is lawful. In this case:
- Appeal to the Regional Administrative Court,
- Then cassation to the Council of State,
- ECHR application (in the international dimension).
Routes of Appeal
Against a first instance court decision:
- Appeal to the Regional Administrative Court,
- Cassation to the Council of State
are possible. Each phase has specific period limits.
Compensation Lawsuits
If a foreigner has suffered damage due to the administration's wrong act or negligence:
- Compensation can be claimed within the scope of administrative liability,
- Material damages (lost money, expenses) and moral damages (suffering, distress) are claimed,
- The claimed amount must be supported by concrete evidence.
Common Mistakes
- Missing the period — the most common and hardest-to-correct mistake.
- Not applying to the competent court — leads to time loss.
- Not requesting a stay of execution — damage grows during trial.
- Missing apostille on documents — foreign documents not processed.
- Filing a lawsuit alone without a lawyer — losing the case due to procedural errors.
