Traffic Accident Criminal Liability for Foreign Drivers in Turkey

In Turkey — particularly in cities like Antalya with heavy tourist traffic — accidents involving foreign drivers are frequent occurrences. Once a traffic accident occurs, multiple legal fronts open protecting both victim and non-victim parties' rights: criminal, administrative, and civil compensation. For the foreign driver, sound management of these multiple processes is critical to controlling both the criminal file and financial outcomes.
Consequences of Traffic Accident: Three Fronts
When a traffic accident occurs, three parallel processes typically arise:
1. Criminal Investigation
If the accident involves injury or death, the prosecutor's office initiates investigation under offences of negligent injury or negligent causing of death. While criminal process generally doesn't run for property-only damage:
- Drugs, alcohol, intentional accidents,
- Driving without licence,
- Fleeing the scene
create criminal liability.
2. Administrative Process (Traffic Penalties)
Traffic police issue tickets for traffic-rule violations; administrative fines and where appropriate licence withdrawal are applied. For foreign driver:
- Turkish driver licence (if any) may be withdrawn,
- Foreign licence recognition period may be reduced,
- Administrative fines unpaid become subject to enforcement.
3. Civil Compensation
Victim's claims for material and moral compensation:
- Met by traffic insurance (compulsory financial liability insurance),
- For damages exceeding insurance limits, lawsuit directly against driver or vehicle owner,
- Compensation case heard at civil court.
Determining Criminal Liability
In Turkish criminal law, traffic accidents are basically evaluated under negligence; that is, the person is liable for failing to exercise due care even without intent to commit offence. In determining liability:
- Expert report — traffic engineer and physician reports,
- Scene investigation report,
- Alcohol/drug test (if applicable),
- Witness statements,
- Vehicle damage photos
are evaluated.
The expert report determines fault percentages: parties' contribution to accident is expressed in percentage. You can be qualified as fully at fault, partially at fault, or without fault.
Driving Under Influence of Alcohol or Drugs
Criminal liability is aggravated for drivers under influence of alcohol or drugs. Additionally:
- Surrender of driver licence,
- Vehicle impoundment,
- Right of subrogation arises after traffic insurance pays the damage (the insurer recovers from the at-fault driver)
apply. The misconception of foreign tourists drinking beer or cocktails and then driving in Turkey can have serious consequences; alcohol limit excesses are strictly monitored.
Fleeing the Scene
Fleeing the scene after accident constitutes a separate offence and increases criminal liability. In addition:
- Right of subrogation for insurance arises,
- Driver licence withdrawn in administrative process,
- For foreigner, deportation possibility strengthens.

Insurance Relationship
Compulsory Traffic Insurance
In Turkey, all motor vehicles must have compulsory financial liability insurance. This insurance:
- Covers material and bodily damages of third parties,
- Covers damage to passengers other than driver,
- Pays compensation within specific limits.
Green Card System for Foreign Drivers
The Green Card System applies to drivers coming from European countries to Turkey. Under this:
- Foreign-plate's home-country insurance is recognised in Turkey,
- Compensation processes run through Turkish Insurance Sector Association.
Comprehensive and Additional Insurance
Comprehensive (kasko) is optional insurance covering damage to driver's own vehicle. If you're using a foreign rental car, you must read the rental contract's insurance package carefully — some packages carry significant excess amounts.
Compensation Lawsuit
When insurance limits are insufficient, the victim may file directly against driver and vehicle owner for:
- Material compensation — treatment expenses, loss of earnings, vehicle damage,
- Moral compensation — for pain and suffering experienced,
- Compensation for deprivation of support — for relatives in case of death.
In setting compensation amount for foreign victims:
- Home-country economic conditions,
- International dimension of medical treatment,
- Translation and travel expenses
may also be considered.
Protecting Rights as a Foreign Victim
If foreign driver is victim in accident:
- Complaint to public prosecutor's office,
- Joining criminal case as complainant / participant,
- Damage notification to traffic insurance company,
- Filing compensation case.
Foreign victim's home-country insurance company may also enter; in this case, coordination between two countries' insurance is needed.
End of Trial: Possible Outcomes
At end of criminal trial, possible outcomes:
- Acquittal — for absence of fault or insufficient evidence,
- Postponement of judgment announcement (HAGB) — for light offences and first-time offenders,
- Fine — common in negligent injury offences,
- Imprisonment — particularly in alcohol, fleeing-resulting, severe-result accidents.
When imprisonment is imposed, for foreigner:
- Place sentence is served,
- Possibility of return to home country,
- Conditional release conditions
are evaluated. Foreigners with finalised sentence in Turkey may, under specific conditions, request to serve their sentence in home country.
Preventive Recommendations for Foreign Drivers
- Understand insurance package well before renting in Turkey — particularly excess amount.
- Alcohol and drugs are zero tolerance — tourist or resident, makes no difference.
- Pay attention to speed and traffic rules — small mistakes can have big consequences in Antalya's busy traffic.
- Stay at scene in case of accident — call medical teams and police.
- Call your lawyer immediately — get legal support before giving statement.
