Can foreigners file for divorce in Turkey?+
Yes. Turkish courts hear divorce cases with international elements where the spouses have a residence in Turkey or a sufficient connection exists. Which country's law applies is determined under the rules of private international law.
Is my foreign divorce decree valid in Turkey?+
Not automatically. For a foreign judgment to take legal effect in Turkey, recognition and enforcement proceedings must be filed. If the judgment is consistent with Turkish public order, it is then registered with the civil registry.
How is custody decided?+
Custody is decided by reference to the child's best interest. Age, physical and psychological care conditions, parents' circumstances, and — where appropriate — the child's own views are considered together. Expert reports may also be obtained.
