Can I use my trademark in Turkey without registering it?+
Unregistered use offers only limited protection; the strongest right in your mark, valid nationwide, is conferred by registration with TÜRKPATENT. Registration prevents others from registering an identical or similar mark and greatly facilitates legal enforcement in the event of infringement.
Is my software protected by copyright in Turkey?+
Yes. Computer programs are protected as works under Law No. 5846 (FSEK), and protection arises automatically upon creation of the work; no separate registration is required. Nonetheless, clearly regulating ownership and the scope of assignment in your contracts is critical to preventing potential future disputes.
What can I do if someone has registered the .tr domain bearing my trademark?+
If the domain is identical to your trademark or trade name, or confusingly similar, and the conditions of the Internet Domain Names Regulation are met, you may initiate the dispute resolution procedure or pursue the court route. The registrant's lack of a legitimate right in that name is one of the key factors that strengthen your claim.
