Family Residence Permit: Guide for Spouses of Turkish Citizens

For foreign spouses of Turkish citizens, the safest and longest-term path to living in Turkey is the family residence permit. Unlike short-term residence permits, this permit can be issued for longer periods and counts toward residence requirements for future Turkish citizenship applications. This guide addresses the most common questions we hear from foreign spouses of Turkish citizens in Antalya.
Who Can Apply for a Family Residence Permit?
Under prevailing foreigners legislation, family residence permits may be granted to:
- The supporter's foreign spouse — supporter being either a Turkish citizen or a foreigner holding a residence permit in Turkey,
- Minor foreign children of the supporter or spouse,
- Dependent foreign children — under specific conditions, including for adult children with disabilities.
This guide focuses on the most common scenario: foreign spouses of Turkish citizens.
Requirement of Genuine Marriage
The application is fundamentally based on a factually cohabiting, genuine marriage. Sham marriages — those entered into solely to obtain residence or citizenship — are grounds for rejection and even deportation. The migration authority verifies marriage authenticity through methods including:
- Interview — separately or together with both spouses,
- Address verification — checking actual cohabitation at the declared address,
- Neighbour testimony — when needed,
- Statement consistency — knowledge of family members, daily life, marriage date.
These checks are not aggressive, but for genuine marriages there's no need to be anxious. Preparation, however, is always beneficial.
Typical Required Documents
Family residence permit applications typically require:
- Passport or equivalent,
- Biometric photographs,
- Turkish-citizen spouse's family registration record (vukuatlı),
- Marriage certificate (whether issued in Turkey or abroad),
- Marriages performed abroad must be registered in Turkey (mernise işlenmiş) before submission,
- Turkish-citizen spouse's criminal record check — convictions for specified offences may bar issuance,
- Valid health insurance,
- Address proof — lease or title deed copy,
- Statement of financial means,
- Tax number.
Common pitfall: Marriages performed abroad must first be registered through a Turkish consulate or directly in Turkey. An unregistered marriage will not be accepted in family residence permit applications.
Permit Duration and Renewal
Family residence permits are issued for periods set within the limits of prevailing legislation. Duration depends on the marriage's nature, spouses' circumstances, and migration authority discretion. Renewals must be filed before expiration; otherwise, the holder's right to remain in Turkey ends.
Renewal applications typically require updated versions of original documents and renewed assessment of whether the marriage continues.
What Happens After Divorce or Separation
Since family residence permits are based on the marriage union, the permit is generally cancelled when the marriage ends. However, exceptions exist:
- If the foreigner has held a family residence permit for at least three years, transition to a short-term residence permit may be possible.
- If a court issues a protection order due to domestic violence by one spouse, protective provisions may apply for the foreign spouse.
- If the Turkish-citizen spouse passes away, the remaining foreign spouse's situation is separately evaluated.
For foreign spouses in divorce or separation processes, immediate legal consultation is critical to avoid losing residence rights.
Counting Toward Citizenship
Time spent on a family residence permit is counted toward the residence requirement for Turkish citizenship applications. For foreigners married to Turkish citizens, marriage must continue for a specified period; once that period elapses, marriage-based citizenship application becomes possible. Concrete calculation of these periods and timing of the application benefit from professional support.
Appealing Rejection Decisions
If a family residence permit application is rejected, a cancellation lawsuit may be filed at the competent Administrative Court within the period prescribed by administrative procedure rules. The most common rejection grounds are:
- Marriage assessed as not genuine,
- Document deficiencies or inconsistent declarations,
- Existing restriction codes,
- Disqualifying entries in Turkish-citizen spouse's criminal record.
Evidence demonstrating marital authenticity — photographs, joint bank accounts, lease agreements, children's birth records, joint travel — should be presented robustly in the lawsuit.
