Turkish Citizenship Application Rejection: Appeal Guide

A rejection of a Turkish citizenship application is a heavy decision that can render an applicant's years of investment, residence, and preparation effort useless. Some applications made through investment, marriage, or exceptional pathways are rejected for various reasons. We have taken many rejected citizenship files of foreign clients in Antalya to court and obtained positive results in a significant portion. This guide examines the legal pathways for challenging rejection decisions.
How Citizenship Applications Are Rejected
Citizenship applications are accepted or rejected through an administrative process. The decision is notified to the applicant; some files clearly state rejection grounds, while others contain only abstract phrasing such as "found unsuitable." Abstract grounds make defence in litigation harder and require sound legal strategy.
Most Common Rejection Reasons
1. Document Deficiency or Apostille/Translation Issues
If a document in the application file:
- Lacks apostille,
- Lacks sworn translation,
- Was submitted in an expired version
it can be a rejection ground. These rejections are the easiest category to remedy; submitting completed documents may permit re-application.
2. Falling Below Investment Threshold
Particularly in investment-based citizenship applications:
- Title declaration below the legislative threshold,
- Inability to evidence foreign-currency origin of investment due to missing DAB,
- Failure to place 3-year no-sale annotation on title
are leading rejection grounds.
3. Background Check Obstacle
Whether the applicant or close family members have:
- Serious criminal convictions in Turkey or abroad,
- Assessment of connection with terrorist organisations,
- Existing restriction codes
these are among rejection grounds. Background-check-based rejections are the hardest category to remedy; however, those based on incorrect concrete information can be corrected through litigation.
4. Sham (Apparent) Marriage Suspicion
In applications by foreign spouses of Turkish citizens, the General Directorate of Population and Citizenship Affairs assesses whether the marriage is genuine. Inconsistent statements during interviews or spouses not appearing to live together can lead to rejection.
5. Criminal Record Disqualifications
Specific criminal records of certain weight in Turkey or abroad are rejection grounds. Sentence expungement or restoration of forbidden rights can sometimes neutralise these records.
6. Insufficient Turkish Language
In some application types, Turkish proficiency is checked through oral interview. Applications deemed insufficient are rejected.
Judicial Review of Rejection
The only legal pathway against citizenship application rejection is filing a cancellation lawsuit at the competent Administrative Court within the period prescribed by administrative procedure rules. The court with jurisdiction is that of the central administration's headquarters location.
Arguments to advance in cancellation litigation:
- The rejection is not supported by concrete evidence,
- The administration used its discretionary power unlawfully,
- Other applicants in similar circumstances were granted citizenship while this file was rejected (equal-treatment violation),
- For document-deficiency rejections, opportunity to rectify was not provided,
- Information used in the background check is concretely incorrect.
Stay of Execution Request
When filing the lawsuit, requesting stay of execution is important. When stay is granted:
- The consequences of the rejection are removed,
- The applicant's expected residence permit and other rights may resume.
Importance of Expert Reports
In complex citizenship files, particularly:
- For files where investment threshold is contested, real estate appraisals,
- For files where marriage authenticity is contested, social investigation reports
are strong evidence courts request. The quality and content of these reports directly affect case outcomes.
Re-Application Strategy
In some cases, instead of — or in parallel with — cancellation litigation, re-application with deficiencies cured is also a strategy. Choice depends on:
- The nature of the rejection ground,
- Whether the deficiency is curable,
- Tolerance of time loss.
This decision, with attention to litigation economics, requires professional experience.
Investment Status After Rejection
The foreign investor whose citizenship is rejected does not lose the real estate or capital investment entirely; however:
- The 3-year no-sale annotation continues, so the property cannot be sold immediately,
- There is no mechanism for the investment to "return with interest,"
- The investor may retain residence rights and other acquired statuses.
In this situation, re-application or judicial annulment should be evaluated as a means of minimising financial losses.

- Investment structure suitability,
- Document completeness,
- Apostille and translation processes,
- Potential background-check obstacles
